Fairhouse Insurance – Messaging Terms & Conditions

These Messaging Terms & Conditions (the “Messaging Terms”) govern the use of SMS/text messaging services (the “Program”) offered by Fairhouse Insurance and its affiliates (collectively, “Fairhouse,” “we,” “our,” or “us”). By enrolling in the Program or otherwise providing your mobile number to Fairhouse, you agree to these Messaging Terms, our Privacy Policy, and our Website Terms of Use, each of which is incorporated herein by reference. If you do not agree to these Messaging Terms, do not enroll in or use the Program.
1. Program Overview
The Program allows individuals who have opted in to receive text (SMS/MMS) messages from Fairhouse for one or more of the following purposes:
- Insurance account updates, billing alerts, and payment reminders
- Policy renewal notices and coverage details
- Customer support and claims-related communications
Enrollment in the Program is voluntary and not a condition of purchase.
2. User Eligibility
By enrolling, you represent and warrant that:
- You are the current authorized user of the mobile number provided;
- You are at least 18 years of age (or the age of majority in your jurisdiction); and
- You have the authority to consent to receive messages at the designated mobile number.
You must notify Fairhouse immediately if your mobile number changes or is reassigned.
3. Message Frequency
Messages may be sent periodically, and frequency will vary depending on your interaction with Fairhouse. The number of messages per month may vary, but we will endeavor to limit marketing messages to no more than 5 per month, unless you provide additional consent. Transactional messages (e.g., payment reminders, claims updates) are not subject to this limitation.
4. Costs and Charges
Fairhouse does not charge a fee to participate in the Program. However, standard message and data rates may apply from your mobile carrier for messages sent and received. Charges may appear on your mobile phone bill or be deducted from your prepaid balance. Contact your mobile service provider for details.
Fairhouse is not responsible for any wireless charges incurred by Program participation.
5. Opt-Out Instructions
You may opt out of receiving text messages at any time by replying with the keyword “STOP” to any message you receive. Upon receipt of a STOP message, we will send you a single confirmation message of your opt-out and cease further messaging.
You understand and agree that:
- Opting out via text is the exclusive and reasonable means of withdrawal;
- You may re-enroll at any time by sending a new text message and you will receive a new opt in message, simply respond “YES” to the new opt in message.

7. Consent Not a Condition of Purchase
You acknowledge and agree that your consent to receive SMS messages is not a condition or requirement to purchase any goods or services from Fairhouse.
8. Privacy and Data Use
We will collect, use, and retain your personal data in accordance with our Privacy Policy. Data collected from you in connection with this Program may include your mobile number, carrier information, time and date of messages, interaction data, and other usage analytics. We do not sell or rent your personal information.
9. Program and Carrier Disclaimers
The Program may not be available on all wireless carriers. Participation is subject to the messaging capabilities of your mobile device and network availability.
Carriers are not liable for delayed, undelivered, or misdirected messages.
Fairhouse does not guarantee the timely delivery or accuracy of any information sent via text. Certain functionality may be limited by your device settings, data restrictions, or location.
10. Modification and Termination of Program
Fairhouse reserves the right to suspend, modify, or terminate the Program or any user’s participation at any time, for any reason, including non-compliance with these Messaging Terms. Continued use of the Program after such changes constitutes your acceptance.
11. Governing Law; Dispute Resolution
These Messaging Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute, controversy, or claim arising out of or relating to these Messaging Terms or your participation in the Program shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee, and you hereby irrevocably consent to the jurisdiction and venue of such courts.
