Fairhouse Insurance – Messaging Terms & Conditions

Effective Date: February 26, 2026

These SMS/Text Messaging Terms & Conditions (the “Messaging Terms”) govern the use of the SMS/text messaging program (the “Program”) offered by Fairhouse Insurance, a trade name of Kaizen Insurance Agency LLC, a Tennessee limited liability company, and its affiliates (collectively, “Fairhouse Insurance,” “Fairhouse,” “we,” “our,” or “us”). By enrolling in the Program or otherwise providing your mobile number and consent to Fairhouse Insurance, you agree to these Messaging Terms, our Privacy Policy (available at www.fairhouseinsurance.com/privacy-policy), and our Website Terms of Use, each of which is incorporated herein by reference. If you do not agree to these Messaging Terms, do not enroll in or use the Program.

1. Program Overview

Fairhouse Insurance is an independent insurance brokerage licensed in TN, MS, AR, and AL. The Program allows individuals who have opted in to receive recurring automated text (SMS/MMS) messages from Fairhouse Insurance for one or more of the following purposes:

  • Insurance quote updates and follow-ups
  • Insurance account updates, billing alerts, and payment reminders
  • Policy renewal notices and coverage details
  • Customer support and claims-related communications
  • Appointment reminders and confirmations

Enrollment in the Program is voluntary and is not a condition of purchasing any insurance product or service from Fairhouse Insurance.

2. Opt-In and Consent

You may opt in to the Program through one of the following methods:

  • Website form: By entering your mobile phone number and checking the SMS consent checkbox on any form at www.fairhouseinsurance.com (such as the “Get a Quote” or “Contact Us” form).
  • Keyword text: By texting a designated keyword (e.g., “INSURANCE” or “QUOTE”) to our designated phone number.
  • Verbal consent: By providing verbal consent during a phone call with a Fairhouse Insurance representative, in which case your consent will be noted in our records.

Regardless of the method, after opting in you will receive the following confirmation message before any additional messages are sent:

“Fairhouse Insurance: You’re now enrolled in text alerts! Expect account updates, billing reminders, and policy info. Msg frequency varies, up to 10 msgs/mo. Msg & data rates may apply. Reply HELP for help. Reply STOP to opt out.”

By opting in, you expressly consent to receive recurring automated SMS/MMS messages from Fairhouse Insurance at the mobile number you provided. You confirm that you are the owner or authorized user of the mobile device associated with the number submitted and that you are authorized to consent to receive text messages at that number.

3. Message Frequency

Message frequency varies depending on your account activity and interactions with Fairhouse Insurance. You may receive up to 10 messages per month. Fairhouse Insurance will not send messages that exceed the scope of the Program as described in Section 1.

4. Message and Data Rates

Fairhouse Insurance does not charge a fee to participate in the Program. However, standard message and data rates may apply from your mobile carrier for each message sent and received. Charges may appear on your mobile phone bill or be deducted from your prepaid balance. Contact your mobile service provider for pricing details.

Fairhouse Insurance is not responsible for any wireless or data charges incurred by your participation in the Program.

5. Opt-Out Instructions

You may opt out of receiving text messages at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any message you receive from Fairhouse Insurance. Upon receipt, we will send you a single confirmation message and cease all further messaging.

After opting out, you may re-enroll at any time by completing the opt-in process again (e.g., submitting a new web form with the SMS consent checkbox checked, or texting our keyword to our designated number).

7. Consent Not a Condition of Purchase

You acknowledge and agree that your consent to receive SMS/MMS messages from Fairhouse Insurance is not a condition or requirement to purchase any insurance product, service, or other goods from Fairhouse Insurance. You may choose not to participate in the Program and still obtain insurance quotes and services from us.

8. User Eligibility

By enrolling in the Program, you represent and warrant that:

  • You are the current owner or authorized user of the mobile phone number provided.

  • You are at least 18 years of age (or the age of majority in your jurisdiction) and
  • You have the authority and legal capacity to consent to receive automated text messages at the designated mobile number.

You must notify Fairhouse Insurance immediately if your mobile number changes or is reassigned to another person.

9. Privacy and Data Use

We collect, use, and retain your personal data in accordance with our Privacy Policy, available at www.fairhouseinsurance.com/privacy-policy. Data collected in connection with this Program may include your mobile phone number, mobile carrier name, opt-in and opt-out dates and times, message interaction data, and other usage analytics.

We do not sell or rent your personal information. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

10. Supported Carriers

The Program is available on most major U.S. wireless carriers. Carriers supported include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and their affiliates. The Program may not be available on all wireless carriers or in all coverage areas.

11. Program and Carrier Disclaimers

Participation in the Program is subject to the messaging capabilities of your mobile device, your wireless carrier’s service terms, and network availability.

Carriers are not liable for delayed, undelivered, or misdirected messages.

Fairhouse Insurance does not guarantee the timely delivery or accuracy of any information sent via text message. Certain functionality may be limited by your device settings, data restrictions, or geographic location. Text messages should not be relied upon as the sole means of communication for time-sensitive matters.

T-Mobile is not liable for delayed or undelivered messages.

12. Prohibited Use

You agree not to use the Program for any unlawful purpose. You may not enroll another person’s phone number without their express consent.

13. Modification and Termination of Program

Fairhouse Insurance reserves the right to suspend, modify, or terminate the Program or any user’s participation at any time, for any reason, including non-compliance with these Messaging Terms. We will make reasonable efforts to notify you of material changes. Continued participation in the Program after changes have been posted constitutes your acceptance of the revised terms.

14. Governing Law; Dispute Resolution

These Messaging Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute, controversy, or claim arising out of or relating to these Messaging Terms or your participation in the Program shall be resolved exclusively in the state or federal courts located in Shelby County, Tennessee, and you hereby irrevocably consent to the jurisdiction and venue of such courts.
